Role of the Committee

The Conveyancing Committee provides information and guidance on conveyancing practice and procedure to conveyancing practitioners and monitors legislative, judicial and practice developments affecting the area of conveyancing, and landlord and tenant law. The Committee is representative of the profession as a whole and is composed of a broad mix of practitioners from small, medium and large sized practices both urban and rural. The objectives of the Committee are:

  1. To release practice notes in the Gazette and the Conveyancing Handbook, alongside guidelines on various conveyancing matters.
  2. To develop standardised conveyancing documents, which have become the norm within the profession.
  3. To act in a representative capacity, the committee submits proposals to various entities on behalf of the Society and the profession.
  4. To provide an extensive collection of conveyancing precedents for practitioner assistance, accessible under Precedents/Other Forms. Additionally, feedback and suggestions from professionals are encouraged and can be directed to the Secretary of the Committee at the Law Society..

Current issues on the Committee's agenda include:

  1. Easements Information Bank

    A new section of the Conveyancing Committee page brings together resources on prescriptive easements.

  2. Seeking feedback on new PRA policy (February 2020)

    The Conveyancing Committee is seeking feedback from practitioners on the PRA's New rejection policy. Please send details to the Secretary to the Committee.

  3. Pre-Contract Title Investigation

    The Committee would like your feedback on how the introduction of pre-contract investigation of title is working in practice since 1 January 2019. Send details to the Secretary to the Committee.

  4. Water Charges and Local Property Tax

    The Committee continues to monitor these issues and will post updates to the site's News section and the Committee News area as they arise. 

  5. Land Registry/Registry of Deeds Matters

    The Committee is represented on the Land Registry/Registry of Deeds Customer Group which meets regularly. Members of the profession who experience difficulties with the Land Registry/Registry of Deeds are asked to inform the Committee

  6. Residential Certificate of Title /Lenders

    The Committee liaises with the lending institutions on an ongoing basis. If you have a difficulty with the documentation in any residential loan package or any procedure operated by a lender, please see if the matter is dealt with in the committee’s guidelines “Residential Mortgage Lending Law Society Approved Certificate of Title Documents 2011 Edition”.
